COVID 19 UPDATE: TRAVELLING TO ITALY AND SARDINIA

Dear All,

given the continuous evolution of the Covid-19 situation in Italy, we are here to send the latest updates, according to which Sardinia is under the lowest national risk range ('white' code region).

Therefore please note that the Council of Ministers has decided to extend the state of emergency on the national territory until 30 April 2021, as a result of the health risk related to the spread of pathologies deriving from transmissible viral agents, with particular reference to the new SARS-CoV-2 coronavirus and the pathology associated with it, COVID-19.

According to Decree-Law No. 2 of 14 January 2021 extending the state of emergency, it has been ordered that, throughout the national territory, a series of restrictive measures apply to travel. Further measures for the national territory are contained in the Decree of the President of the Council of Ministers of 2nd of March 2021, which also regulates travel to/from abroad and remains in force from 6th of March 2021 to 6th of April 2021.

As explained in the Decree, the national territory, where differentiated measures are in force, is divided according to four risk bands (white, yellow, orange, red). The membership of an autonomous region or province, or other area of the territory, in one or the other band is subject to periodic review.

As mentioned before, Sardinia has been since 01/03/2020 the only region in the white risk range, therefore the lowest national risk range. The status of a white zone in Sardinia will remain for the current three weeks until new governement update and it translates as follows:

For all those who intend to travel to/from Italy, we suggest the use of a questionnaire based and updated on the Italian legislation currently in force. The questionnaire is purely informative, has no legal value and the result obtained does not guarantee entry into Italy or the country of destination.

Travel to/from abroad is regulated by the Ministerial Decree (DPCM) of 02nd of March 2021, in force from 6 th of March until 6th of April 2021. The DPCM continues to be based on lists of countries for which different measures are envisaged. These lists are contained in Annex 20 (see picture above and list below) and can be amended by a special Ordinance adopted by the Minister of Health, in agreement with the Minister of Foreign Affairs and International Cooperation.

Below are the lists of countries :

A – San Marino, Vatican City

B – States and territories with low epidemiological risk that will be identified, among those listed in List C, by order adopted pursuant to Article 6, paragraph 2 of the DPCM of 14 January 2021. At the moment, no state is on this list.

C - Austria (with specific limitations, please contact us for more infos), Belgium, Bulgaria, Cyprus, Croatia, Denmark (including faer oer islands and Greenland), Estonia, Finland, France (including Guadeloupe, Martinique, Guyana, Réunion, Mayotte and excluding other territories outside the European continent), Germany, Greece, Ireland, Latvia, Lithuania, Luxembourg, Malta, the Netherlands (excluding territories outside the European continent), Poland, Portugal (including the Azores and Madeira), the Czech Republic, Romania, Slovakia, Slovenia, Spain (including territories on the African continent), Sweden, Hungary, Iceland, Norway, Liechtenstein, Switzerland, Andorra, Monaco.

D – Australia, Japan, New Zealand, The Republic of Korea, Rwanda, Singapore, Thailand, as well as the other states and territories with low epidemiological risk, which will be identified, among those listed in List E, by order adopted pursuant to Article 6(2) of the DPCM of 14 January 2021:

E- Rest of the world (i.e. all states and territories not expressly mentioned in other lists – please note that the United Kingdom is in List E. However, the rules governing entry arrangements for those who come directly from Brazil or the United Kingdom, or who have stayed/transited there in the previous 14 days, differ from those normally provided for in List E)

It is prohibited to travel to States and territories referred to in List E of Annex 20, as well as entry into and transit through the national territory to persons who have transited or stayed in the States and territories mentioned in the same list E in the previous fourteen days preceding that date, unless one or more of the following apply reasons, evidenced by the declaration referred to in art. 7, paragraph 1: 
a) work requirements; 
b) absolute urgency; 
c) health needs; 
d) study needs; 
e) return to one's domicile, home or residence; 
f) entry into the national territory by citizens of Member States of the European Union, of States party to the Schengen Agreement, Andorra, the Principality of Monaco, the Republic of San Marino, the State of the San Marino, the Vatican City State; 
g) entry into national territory by family members of the natural persons referred to in subparagraph f) - as defined by Articles 2 and 3 of Directive 2004/38/EC of the European Parliament and the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States and their family members to move and reside freely within the territory of the Member States and amending Regulation (EEC) No 1612/68 and repealing Directives 64/221/EEC,68/360/EEC, 72/194/EEC, 73/148/EEC, 75/34/EEC, 75/35/EEC, 90/364/EEC,90/365/EEC and 93/96/EEC- ; 
h) entry into the national territory by nationals of third-country nationals who are long-term residents pursuant to Council Directive 2003/109/EC of the Council of 25 November 2003 on the status of third-country nationals who are long-term residents,as well as citizens of third States who derive their right of residence from other European provisions or national legislation; 
i) entry into the national territory by family members of the individuals natural persons referred to in subparagraph h), - as defined by Articles 2 and 3 of Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members and their family members to move and reside freely within the territory of the Member States and amending Regulation (EEC) No 1612/68 and repealing Directives 64/221/EEC, 68/360/EEC, 72/194/EEC, 73/148/EEC, 75/34/EEC, 75/35/EEC, 90/364/EEC,90/365/EEC and 93/96/EEC- ; 
l) entry into the national territory in order to reach domicile, home or residence of a person referred to in subparagraphs letters f) and h), even if not cohabiting, with whom there is a proven and stable emotional with whom there is a proven and stable emotional relationship. (...)
  

 1. Notwithstanding the prohibitions and limitations on entry into Italy established in art. 49, anyone who enters the national territory for any length of time from national territory from foreign countries or territories as per lists B, C, D, and E of Annex 20 is required to deliver to the carrier at the time of embarkation and to whoever is appointed to carry out controls a declaration made pursuant to articles 46 and 47 of the Presidential Decree no. 445 of December 28, 2000, indicating in a clear and detailed manner, such as to enable checks to be carried out, of:
a) Countries and foreign territories in which the person has stayed or transited in the fourteen days prior to entry into Italy; 
b) reasons for the movement in accordance with art. 49, in the case of entry from States and territories referred to in List E of Annex 20; 
c) in case of stay or transit in the fourteen days preceding the entry in Italy in one of the following countries prior to entry into Italy in one or more of the States and territories referred to in lists D, and E of Annex 20:
1) full address of the dwelling or residence in Italy where the period of sanitary surveillance and isolation will be carried out fiduciary isolation; 
2) means of private transport that will be used to reach the place referred to in paragraph 1) or, exclusively in case of entry into Italy by air transport line, additional scheduled air transport which will be used to reach the place of final destination and the identification code of the ticket; 
3) the telephone number, also mobile, at which to receive the communications during the entire period of health surveillance and fiduciary isolation; 
4) possible existence of one or more of the circumstances referred to in art. 51, paragraph 7, of last Decree.

2. In the cases expressly provided for by the present decree and in the other cases in which this is prescribed by the health authority within the framework of the safety protocols provided for in this decree, it is obligatory to present to the carrier at the time of embarkation and to whoever is appointed to carry out the controls a certificate of having undergone, within forty-eight hours prior to entry into national territory, to a molecular or antigenic test, carried out by means of a swab and found to be negative. 

3. Persons who have stayed in or transited through the country in the fourteen days prior to entering Italy, in States or territories listed in lists C, D and E of Annex 20, even if asymptomatic, are obliged to immediately communicate their entry into the national territory to the Department of Prevention of the competent health agency. 

4. In case of the onset of symptoms COVID-19, it remains the obligation for anyone to report this situation with timeliness 'to Health Authority and to undergo, pending the subsequent determinations of the Health Authority, to isolation.
