Dear All,

when crusing Sardinian waters, please be aware that on August 6, 2024, at the headquarters of the National Park Authority of the La Maddalena Archipelago, the Special Commissioner has ordered new changes in La Maddalena's park regulations.

Please find below an extract of the new regulation already in force, which includes changes to the permitted hours for overnight stays in La Maddalena Park, as well as potential penalties for violators.


ARTICLE I

In Zone Ma, anchoring is not permitted;

Anchoring is prohibited from 9:00 PM to 8:00 AM throughout the marine area of the La Maddalena Archipelago National Park for all recreational vessels, including recreational vessels engaged in rental, leasing, occasional rental, sailing school, diving, and snorkeling activities;

ARTICLE 2

Nighttime stays (from 9:00 PM to 8:00 AM) are only permitted at mooring buoys installed by the Park Authority (not suitable for boats over 15m) or at anchor, for recreational vessels owned by individuals residing in the municipality of La Maddalena (or owned by companies with legal headquarters in the Municipality of La Maddalena for at least 5 years from the date of approval of this ordinance), provided that these vessels are equipped with sewage collection tanks when onboard services are present;

ARTICLE 3

Mooring of recreational vessels at buoy fields owned by private entities granted under a maritime state concession follows the regulations of the respective authorization title.

ARTICLE 4

During the time slot from 9:30 AM to 5:00 PM, the use of mooring buoys designated for passenger transport vessels is prohibited for any recreational vessel (boats, yachts, and recreational ships); for this purpose, these buoys are appropriately identified with suitable signage placed on the buoy indicating that it is reserved for passenger transport vessels.


DISCIPLINARY ACTION

Unless the act constitutes a more serious offense and without prejudice to the provisions of the Navigation Code and Legislative Decree 171/2005 "Code of Recreational Boating" and the provisions contained in Law 394/1991 and subsequent amendments and additions:

Violations of this Ordinance are punishable by an administrative fine ranging from 276 euros to 1,377 euros. Reduced payment amounts to 459 euros;

If the violation is committed with a recreational vessel used for commercial activities (as defined by Article 2 of Legislative Decree 171/05) or engaged in occasional rental activities, the fine is increased by one third, with a reduced payment of 596 euros;

If the violation is repeated within 90 days, the authorization to operate for commercial activities is suspended for a period of 7 days;

In the most serious cases of violation of the provisions of this Ordinance and prescribed regulations resulting in damage to the infrastructure installed by the Park Authority, this Administration may request compensation for damages;

This Ordinance shall be given the widest and most extensive public dissemination immediately and over time;

The Director of the Park Authority is mandated to disseminate these provisions throughout the territory of the National Park and to provide adequate forms of information to users;

This Ordinance shall be immediately enforceable upon publication in the Register of the Park Authority and shall be sent within three days to the Supervisory Bodies and all Entities with relevant powers
