SUPERYACHT MARINAS REGULATIONS DUE TO COVID-19 - UPDATE 23.04.20

Please consider all the following regulations are constantly changing and being updated on a day to day basis. Here is the list of countries and their regulations as per 23.04.20


SARDINIA

Maritime and aerial traffic from and to Sardinia is suspended (Interministerial Decree of the Ministry of Infrastructure and Transport - Ministry of Health n. 145 of 03.04.2020 which updates decrees n. 117 of 14.03.2020 and President's Ordinances n. 19 of 13.04.2020 of the President of the Sardinia Region extending the n.9 / 2020; n. 13/2020, n.15 / 2020; Interministerial Decree Ministry of Infrastructure and Transport - Ministry of Health n. 153 of 12.04.2020). 

Movements are allowed only for proven working needs, absolute urgency, health reasons and provisioning transport. The Sardinia Region authorises or refuses the entrance/departure by evaluating the “Authorisations request with self-declaration” which can be filled in on the region website.

Passengers can move from/to Sardinia only for the above needs and have to get the “Extraordinary authorisations request for boarding passengers to and from Sardinia” extended until 03 May 2020.
Citizens are not allowed to move by public or private transport to a different municipality from where they have residency or domicile, unless they can demonstrate by self-declaration form proven working needs, absolute urgency, health reasons and provisioning transport (Ministerial Decree 22 March 2020).
The lockdown deadline is 03/05/2020 and we truly hope to come back to you all with more positive news afterwards. 


REST OF ITALY 

Almost in all the Italian territory, maritime and aerial traffic is suspended pursuant to the Decree of the President of the Ministry council 10/04/2020 (Further implementing regulations of the decree-law 25 March 2020, n. 19). Generally movements are allowed only for proven working needs, absolute urgency, health reasons and provisioning transport. The lockdown deadline is 03/05/2020.

In some ports/regions maritime traffic is allowed only for some technical calls with proven working needs:

Sicily: yachts entry for technical repairs, provisioning, bunkering allowed. Only crew are allowed on board, no guests as the touristic movements are not allowed. In Siracusa port only private yachts are allowed; in Riposto and Catania also commercial ones are accepted. In both cases the entry is allowed only after completion of sanitary papers. Crew have to stay on board during the quarantine period, but they are allowed to do only some light sport activities 200 mt from the yacht (walking, running). Cleaning / general maintenance onboard is permitted.

Tuscany: maritime traffic is allowed by Capitanery only after evaluation of papers for technical calls with proven working needs: technical repairs in shipyards, provisioning, bunkering. Only crew are allowed on board, no guests as the touristic movements are blocked so far. 

Liguria: In Liguria ports, specifically Genoa, the Capitanery evaluates and allows yachts entrance only for operational and technical calls with proven working needs and related procedures/docs required: urgent repairs, previous contracts with marinas. As per last decree signed by the President of Liguria Region (nr. 19 14/04/20), local shipyards can reopen for limited works. The movements of boats to shipyards are allowed for maintenance interventions of artisan character done by third parties only, not directly by the owner. These are functional activities to ensure the continuity of the supply chain.

CROATIA

Croatian borders still closed for any international inbound traffic until May 18th.
Inbound international traffic: so far still the same, only yachts heading into a local shipyard are allowed to enter Croatian waters. Prior going in the yard the yacht will have to spend 2 weeks or less (depending from where it’s coming) in quarantine at anchor. This shall remain the case till May 18th.
Crew: Inbound and outbound crew movements are allowed. Inbound crew will have to spend in self financed 2 weeks quarantine prior joining the yacht.
Guests: so far no movements allowed.
Cruising: so far no cruising allowed even with only crew onboard.
Local marinas and ports: they are trying to convince the authorities to have the same regulations as the shipyards.


FRANCE

French ports are still closed until 11/05, but the boat movements are allowed only in exceptional cases, which have to be verified and approved by local authorities. Boats can leave the port to return to their base port.

Crew movements allowed only in case they return to their country of residence by presenting a copy of the air ticket, accompanied by a shipping agent who takes charge of them and awaits the departure of the flight by requesting certification of confirmed departure issued by the airport.
At the moment, the borders in France are still closed from outside the EU until mid-May. It is expected to extend the closure until September - more updates are expected on this.

Some suppliers, can carry out work on board with due precautions but only with previous evaluation and authorization of local Port Authority based on the actual need.


GREECE

All the borders and all the measurements are extended till 27th April, so ports and marinas closed until 27/04.
As there are very good feedbacks generally in Greece (less victims and deaths), they really hope to have good news as soon as possible and to start the business soon.


MALTA

Airport and Ports remain on lock-down until further notice. No yachts are being allowed to enter the Port of Malta for whatever reason.


MONTENEGRO

Maritime and aerial traffic from and to Montenegro is suspended until further notice.


SPAIN

Temporary restrictions for non-essential trips from third countries to the EU have been extended until May 15th. After evaluating the pandemic situation in the Member States, both in the Schengen area and third countries, the European Commission has recommended to extend until May 15th the temporary restrictions of non-essential trips from third party countries to the European Union and Schengen partner countries.
Applicable criteria to deny entry to Spain for reasons of public order and public health due to COVID-19 crisis.

Any person from a THIRD COUNTRY shall be subject to refusal of entry, for reasons of public order or public health, unless belonging to one of the following categories:

1. European Union residents, as well as the spouse or partner of a Union citizen with which he/she maintains a union analogous to the spouse registered in a public registry and those ancestors and descendants who live under their care, and residents in the Schengen or Andorra associated States, which go directly to their place of home.
2. Holders of a long-term visa issued by a Member State or Schengen Associated State addressing it.
3. Cross-border workers.
4. Healthcare or elderly care professionals heading to or returning from exercise their work activity.
5. Personnel dedicated to the transport of goods in the exercise of their work activity, which includes the crew of ships, in order to ensure the provision of maritime transport services and fishing activity; and the flight personnel necessary to carry out commercial air transport activities.
6. Diplomatic, consular, international, military personnel and members of humanitarian organizations, in the exercise of their functions.
7. People traveling for imperative family reasons duly accredited
8. People who can documentary prove reasons of force majeure or situations of necessity, or whose entry is permitted on humanitarian reasons.

Concerning the entry, free movement and residence in Spain of citizens of the Member States of the European Union and of other States party of the Agreement on the European Economic Area, it will be considered appropriate to deny entry by reasons of public order or public health to citizens of the Union and their families who do not belong to one of the following categories:

1. Registered as residents in Spain or going directly to your place of residence in another Member State, Schengen Associated State or Andorra.
2. Those included in paragraphs 3) to 8) of section above of this post.

CARIBBEANS

ANTIGUA AND BARBUDA

At the moment all ports and airports are on a lockdown for any passenger traffic. Only cargo shipments are being accommodated. No new vessels are allowed entry into Antigua and Barbuda.   


COSTA RICA 

All import freights from China are being fumigated on arrival at Ports, including vehicles.
Every vessel from China must report with 24 hrs prior arrival the conditions of all crew members on board.
Only Costa Ricans are allowed to enter the country.
Crew change and shore leave are not permitted


DOMINICA REPUBLIC

Dominican Government applies all measures taken during the state of emergency, until April 30th.
 - Curfew remains, from 5pm to 6am
 - During the rest of the day people can move to carry out their activities or essential purchases, inside or outside their locality.
 - Social isolation is maintained for all citizens
 - All borders remain closed
 - Marine and air traffic is suspended
The only commercial activities permitted are those carried out to maintain the food chain, health facilities and essential services, such as banks.
- As a precautionary measure, Port Administration must take special notice of vessels that originate or have stopped at ports of China and that on arrival it is determined, in coordination with the Agent, the ship's Captain and the Ministry of Public Health in the corresponding Port that a crew member or a passenger shows symptoms of the referred virus.
- Shore leave pass and crew change is not permitted.


GRENADA

Restrictions strengthened since March, Grenada is in state of emergency. Lockdown until April 27th. All non essential businesses and public transportation systems are closed until further notice.
Grenada's ports of entry are currently closed. “Cargo vessels bringing vital goods are permitted but no private boats are allowed to clear in at this time. No person shall be permitted to enter and disembark for any reasons including transiting through Grenada, except with the permission of the Ports Authority and the Ministry of Health;
No crew member will be allowed shore pass, unless for the purposes of operational difficulties and upon receiving permission from the port authority”.
14 day quarantine protocols are also still in place. This means theoretically speaking, no boat/crew can go ashore until they have self quarantined for 14 days, and provided a medical declaration to the authorities.  


JAMAICA

Crew change and shore leave permitted subject to authorisation of Ministry of Public Health. Effective since the 21st March 2020, Jamaica’s air and sea ports remains closed to incoming passenger traffic.


PANAMA

All vessels shall report at 96hrs before their arrival in Panama waters. Present their last 10 port call list (to check if vessel passed from infected ports to take the proper boarding measure). The vessel must notify if any crew member onboard has any symptoms or suspected COVID-19 cases It must provide health declaration and vaccination list documents. This will be done through VUMPA (Panama Canal authority system) and to local health department.

Crew change and shore pass is not permitted. In an effort to reduce the risk of contagion the Embarkation and Disembarkation of crew members from ships, cruises, commercial vessels or any other International maritime vessel have been. Suspended Temporarily in the Territory of the Republic of Panama by the local Health Authority. The crew of vessels that need to go alongside berth, will have to remain in observation and will be monitored for 14 days, after which the Health Authority will assess if there is any risk to the public health.
As for vessels carrying cargo operations, the only personnel that will be allowed onboard will be the one strictly needed to carry out the operation and these personnel have to comply with all the sanitary measures required to avoid contagion.
Nationals or foreigners with residence in Panama coming from abroad will have a compulsory 14 days quarantine at home.


PUERTO RICO

Passenger vessels or any vessel carrying passengers that have been to China (excluding Hong Kong and Macau) or embarked passengers who have been in China (excluding Hong Kong and Macau) within the last 14 days will be denied entry into the United States. If all passengers exceed 14 days since being in China (excluding Hong Kong and Macau) and are symptom free, the vessel will be permitted to enter the United States to conduct normal operations.
Non-passenger commercial vessels that have been to China (excluding Hong Kong and Macau) or embarked crew members who have been in China (excluding Hong Kong and Macau) within the last 14 days, with no sick crewmembers, will be allowed to enter the U.S. and conduct normal operations, with restrictions. Crew members on these vessels will be required under COTP authority to remain aboard the vessel except to conduct specific activities directly related to vessel cargo or provisioning operations.
The Coast Guard considers it an hazardous condition under 33 CFR 160.216 if a crewmember who was in China (excluding Hong Kong and Macau) within the past 14 days is brought onboard the vessel during transit. This requires immediate notification to the nearest Coast Guard Captain of the Port.
Crew change and shore change are permitted subject to US restrictions.
Per 42 CFR 71.21, vessels destined for a U.S. port are required to report to the CDC any sick or deceased crew/passengers during the 15 days prior to arrival at a U.S. port.


SAINT LUCIA

All borders are closed until June.


ST BARTH

All touristic activities are suspended. Cargo ships are authorised to operate at the moment.
Vessels have to stay at anchor and are not authorised to go ashore. Quarantine on board is required. The 11th of May will be the first move on a long way to back to normal but at this time no one knows how and what will be the conditions, at the moment only locals are permitted to go back to the island with an authorization.


ST KITTS

The Federation of St.Kitts & Nevis has not opened any of its Air or Sea ports to leisure traffic yet.
Slowly re-opening the local economy.


ST MAARTEN

The airport is closed to commercial flights. Ports are open for freight and provisioning.  
Complete lockdown, with certain essential services being opened to the public Monday / Wednesday / Friday. Certain other emergency services are also allowed to operate, including marine businesses for urgent requirements.
